Infosys Opposes Moonlighting, Disciplinary Action In Case Of Defying Orders

India's major IT firm Infosys gives a stern message to its employees that they could face termination in case they go for side jobs outside regular hours of work. With taglines ‘No two-timing, no moonlighting’ and ‘No double lives.'

“At Infosys, dual employment is not permitted as per the employee handbook and the code of conduct. As clearly stated in your offer letter, you agree not to take employment, whether full-time or part-time as director/ partner/member/employee of any other organization/entity engaged in any form of business activity without the consent of Infosys. The consent may be given subject to any terms and conditions that the company may think fit and may be withdrawn at any time at the discretion of the company,” the mail from the company to its employees said.

In a recent conversation with Infosys EVP and group HR Head Krish Shankar where TOI asked about moonlighting, side hustles & gig workforce, he did not directly talk about the issue, but said the company is encouraging employees to do internal gigs, if they have the time and interest to do so, beyond their regular work. “We created a platform called Accelerate. When it was initially envisaged a few years back, it was to keep the bench people occupied. But now, Accelerate is used for our internal gigs and during the last two years we are rewarding people doing internal gigs,” he said.

The Nascent Information Technology Employees Senate (NITES), a non-profit group, raised objections over Infosys’s email and said : “IT Employees are working more than 9 hours a day without any overtime benefits. Would there be any energy or time left if an employee is working 10-12 hours a day. Also, many IT companies have developed monitoring systems to measure employee’s productivity.

"Employees have contract to work with Infosys for 9 hours only. What the employees do outside working hours is their prerogative. The article 21 of Constitution of India has provided Right to livelihood to every citizen hence such emails sent to the employees is illegal and unethical. Citing clauses of contract will not help Infosys in the court of law as the clauses are included arbitrarily,” said NITES in an email.
